Version 1.0 · Effective 21 August 2026 Flex Up, by Circular Stream S.L. — Canary Islands, Spain
This Scale is the document referred to in Section 9 of the Terms and Conditions. It determines any sum that may be invoiced at the end of a contract. It is accepted separately, with its own checkbox, before subscription. The version you accept applies to your equipment for the whole of your contract.
1. How this Scale is applied
When equipment is returned, it is assessed against this Scale. Any invoice is accompanied by a detailed condition report identifying each item assessed and the corresponding entries below. The debit occurs no earlier than 14 days after the report and invoice are sent; you may contest the report before the debit date, and we answer before debiting.
Amounts are never discretionary: every charge traces to an entry in this document.
2. Normal wear — never charged
Wear resulting from ordinary use over your subscription period is priced into your subscription and gives rise to no invoice. This includes, for example: surface scratches from normal handling, softening of sails and canopies through regular sessions, fading from normal sun exposure, and light abrasion on pads, straps and lines consistent with the subscription period.
3. Damage classification
Damage is classified from XS to XXL per product category. Damage entries are cumulative: several small damages add up.
Sail / Wing / Kite (canopy) — cuts are cumulative
| Size | Definition |
|---|---|
| XS | Cut under 5 cm |
| S | Cut under 10 cm |
| M | Cut under 20 cm |
| L | Cut over 20 cm · or under 5 cm on inflatable structures |
| XL | Cut over 20 cm · or over 5 cm on inflatable structures |
Board — dings are cumulative
| Size | Definition |
|---|---|
| XS | Very small ding |
| S | Small ding / big scratches |
| M | Medium ding |
| L | Large ding |
| XL | Many dings small and large; broken, bent or waterlogged boards; broken fin box |
Foil / TT / Tiki — dings are cumulative
| Size | Definition |
|---|---|
| XS | Very small ding |
| S | Small ding / big scratches |
| M | Medium ding |
| L | Large ding |
| XL | Many dings small and large |
Mast / Bar — dings cumulative · 1 knot = 1 broken line
| Size | Definition |
|---|---|
| XS | Very small ding |
| S | Small ding / big scratches |
| M | Medium ding · per broken line |
| L | Large ding · 1 broken line = replace 2 |
| XL | Many dings small and large |
4. Value compensation grid
Each damage size corresponds to a fixed value compensation per product category, reflecting the market value impact of the damage at the time of return. Fixed amounts mean you always know in advance what to expect.
| Size | Sail | Board | Foil/TT | Mast/Bar |
|---|---|---|---|---|
| XS | 75 € | 50 € | 25 € | 25 € |
| S | 100 € | 75 € | 50 € | 50 € |
| M | 125 € | 100 € | 75 € | 75 € |
| L | 150 € | 150 € | 100 € | 100 € |
| XL | 175 € | 200 € | 150 € | 150 € |
| XXL* | — | — | — | — |
* XXL — severe damage. Where damage exceeds XL (e.g. destruction or damage beyond economical repair), the grid no longer applies; instead a franchise expressed as a percentage of the item’s value applies:
| No FlexCare | FlexCare Optimum | FlexCare Premium | |
|---|---|---|---|
| Franchise at XXL (% of item value) | 50 % | 35 % | 25 % |
The item’s value is its current as-new value as communicated when the product was provided to you.
5. Repair
5.1 Damage beyond normal wear must be repaired. Repair costs are always the Client’s responsibility; they are separate from, and additional to, value compensation.
5.2 Repair by you or for you. A repair is accepted where it is performed to professional standard:
- clean, workmanlike execution;
- materials adequate for the product and matching the original (a sail repaired with a different fabric, or a different colour, at the repaired area, is not a conforming repair);
- structural integrity restored for the intended use.
You may evidence a conforming repair with the repairer’s invoice.
5.3 Repair by our workshop. A repair not carried out, or not meeting the criteria at 5.2, is performed by our workshop and invoiced, itemised in the condition report.
5.4 A conforming repair may still leave a repair history that reduces the product’s market value; that residual impact is what the value compensation grid (Section 4) covers.
6. Overuse
Every piece of gear has a natural lifespan. Where equipment is returned with wear significantly beyond what its subscription period would normally produce — hundreds of hours in punishing conditions, prolonged sun exposure, neglect — an overuse compensation applies.
Overuse compensation is applied sparingly, only for genuinely obvious, visible and undeniable cases — never for normal intensive use. For intensive riders, the Switch option is almost always more cost-effective.
| Category | CHILLED | BRUTAL |
|---|---|---|
| Sail / Wing / Kite | 99 € | 149 € |
| Board | 49 € | 99 € |
| Foil / TT / Tiki | 29 € | 49 € |
| Mast / Bar | 29 € | 49 € |
Overuse compensation is cumulative with damage compensation where both apply, and is not covered by FlexCare.
7. Non-return, loss and theft
Equipment must always be returned, even when damaged. In case of loss or theft, the Buy Out option applies (Terms, Section 16). Non-return is governed by Section 12 of the Terms.
8. Condition categories at subscription
The condition category stated before payment (“new”, “like new”, “used — minor wear”) is assessed against the same classification as Section 3: a product with no entries above XS is “like new”; a product with documented entries at S is “used — minor wear”. Your product’s condition at provision is recorded and is the baseline for the end-of-contract assessment — you are never charged for damage documented before your Starting Date.
